THE APPEALS PROCESS After filing your claim for benefits with the Social Security Administration, it will be reviewed by the Disability Determination Service (DDS).  If your initial application is denied, the Social Security Administration has an established appeals process.

  1. Reconsideration

At the Reconsideration level, the Disability Determination Service (DDS) will re-evaluate the medical evidence and issue a new decision.  If your claim is denied at the reconsideration level, the next appeal is a request for an administrative hearing before a United States Administrative Law Judge (ALJ).

  1. Administrative Hearing

The ALJ will make a new and independent decision in your claim and will not be bound by the prior decisions issued by the Social Security Administration.  The Claimant is given the opportunity to appear before the ALJ and to provide their testimony as it relates to their medical conditions and impairments.  If the claimant’s claim is denied at the administrative hearing level, the next step is to request the Appeals Council to review the ALJ decision.

  1. Appeals Council

The Claimant and his or her representative must file a Request for Review within 60 days of the adverse administrative hearing decision.  The Claimant and his or her representative are given the opportunity to present additional evidence and to present legal argument as to any legal errors that may have been committed by the ALJ.  If the claim is denied by the Appeals Council, the final step is to file a complaint for judicial review in Federal Court.

  1. Judicial Review in Federal Court.
